How Much Can a Public Adjuster Charge in Florida?
Florida law caps public adjuster fees. For most claims, the maximum is 20% of the claim payment. For claims arising from a declared emergency, such as a hurricane, the cap drops to 10% during the first year after the declaration. These caps are set by Florida Statute 627.428 and related regulations.
What the Cap Covers
- The fee is a percentage of what the insurer pays on the claim.
- You pay nothing on money the insurer already paid before you hired the adjuster.
- If there is no additional recovery beyond what the carrier already paid, there is no fee.
- The fee comes from the settlement, not out of your pocket upfront.
Why the Cap Exists
The legislature set these limits so owners keep the majority of every recovery. Florida caps the fee at 10% for claims filed during a state of emergency. And 10% of nothing is nothing. Without representation, many homeowners walk away with far less or nothing at all.
